ABSTRACT
This study with Jean Jacques Rousseau's conception of General Will. It attempted to give philosophical evaluation of the Anti-Terrorism Law. In chapter 1, it focuses on the problem and how it arises.
In Chapter 2, it exposes Jean Jacques Rousseau as the philosopher of the General Will. Rousseau argues that in order for the general will to be truly general, it must come from all and apply to all. This thought has both state-oriented and open aspects. Rousseau argues that the law should be a reflection to the general will. As the general will progresses the law should be applicable to all.
In Chapter 3, it shows the concept of the Philippine Anti-Terrorism Law. Anti-terrorism legislation are laws with the purpose of fighting terrorism. The law defined acts of terror as activities intended to kill someone or put someone's life in danger. Whoever is engaged in these activities are held and considered a terrorist.
In Chapter 4, it presents the appropriation of General Will of Rousseau to the Anti-Terrorism Law. It notes that the General Will principle is being appropriated in to the law itself and to promote common good is what everyone must morally aim for. For according to Rousseau, '''the purpose of the state is for safeguarding the common good, the law or the state is the real definition of Rousseau's general will.
The study ends with summary, conclusion and recommendations. Recommendations extracted from the significance of Rousseau's General Will into the present law.
